Terms and Conditions

Welcome to Lodavo. These Terms and Conditions ("Terms") govern your access to and use of the website located at www.lodavo.ca (the "Site"), the Lodavo mobile application (the "App"), and any related services provided by Lodavo Inc. ("Lodavo," "we," "us," or "our"), collectively referred to as the "Services."

By creating an account or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

1. Definitions

  • "Account" means the personal account you create to access and use the Services.
  • "App" means the Lodavo mobile application available on iOS and Android.
  • "Contest" means the weekly prize-linked savings draw operated through the Services, governed by the Contest Rules.
  • "Contest Rules" means the official contest rules available at www.lodavo.ca/contest-rules.
  • "Services" means the Site, the App, and any related services provided by Lodavo.
  • "Site" means the website located at www.lodavo.ca.
  • "User," "you," or "your" means any individual who accesses or uses the Services.

2. Account Terms

Eligibility

To create an Account and use the Services, you must:

  • Be a legal resident of Canada.
  • Be at least 18 years of age. If the age of majority in your province or territory of residence is higher than 18, you may still create and use an Account at 18, but you will not be eligible to participate in prize draws (including weekly prizes and the jackpot) until you reach the age of majority for your province or territory. We will automatically restore your prize-draw eligibility on the day you reach that age.

Account Registration

You agree to provide accurate, current, and complete information during registration and to keep your Account information up to date. You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account.

One Account Per Person

Each individual may create and maintain only one Account. Creating multiple accounts is a violation of these Terms and may result in immediate termination of all associated accounts. Lodavo may use technical signals — including device identifiers and network information — to detect and investigate potential multi-account abuse. These signals are reviewed by authorized personnel and are not used to automatically block or deny service. For details on the data collected, see our Privacy Policy.

Account Security

You are responsible for maintaining the security of your login credentials and the email account associated with your Lodavo Account. You agree to notify us immediately at contact@lodavo.ca if you become aware of any unauthorized access to or use of your Account.

Account Suspension and Termination

We reserve the right to suspend or terminate your Account at our discretion if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or otherwise misused the Services. We will provide you with notice and an opportunity to be heard before termination, except in cases of fraud or imminent harm.

Account Deletion

You may delete your Account at any time through the App (Settings) or by contacting us at contact@lodavo.ca. Upon deletion, your personal information will be handled in accordance with the retention schedule described in our Privacy Policy.

3. Plaid Bank Account Linking

Not a Financial Institution

Lodavo is not a bank, credit union, trust company, or financial institution. We do not hold deposits, provide financial advice, or act as a fiduciary. The Services are a contest platform that uses savings balance information to determine contest ticket eligibility.

How Plaid Works

When you link a bank account through the Services, you connect via Plaid Inc. ("Plaid"), a third-party financial data aggregator. Plaid handles your bank login credentials directly — Lodavo never receives, accesses, or stores your bank username or password.

Balance Data

The savings balance information retrieved through Plaid is used solely to calculate your weekly ticket allocation. Balance data is informational and is based on what your financial institution reports to Plaid. Lodavo does not guarantee the accuracy, completeness, or timeliness of bank-reported data.

Your Relationship with Plaid

Your use of Plaid is subject to Plaid's own End User Privacy Policy (available at https://plaid.com/legal). By linking a bank account, you authorize Plaid to access your financial data and transmit it to Lodavo for the purposes described in our Privacy Policy.

Unlinking

You may unlink your bank account at any time through the App. Unlinking will stop future balance snapshots and ticket allocations but will not affect tickets or draw entries already issued.

4. Contest and Prizes

Contest Rules

The weekly contest is governed by the Contest Rules, available at www.lodavo.ca/contest-rules. By participating in the Contest, you agree to the Contest Rules, which are incorporated into these Terms by reference.

No purchase necessary. Skill-testing question required. See Contest Rules for complete rules, entry methods, terms, and odds.

Prize Claims

Prize claims are subject to identity verification, completion of a declaration and release (waiver), and correct response to a skill-testing question. Lodavo reserves the right to withhold prizes if these conditions are not met.

5. Winner Display

If you win a prize and complete the prize claim process (including the declaration and release), your first name, last initial, and province of residence will be displayed to other users in draw results and winner history. This display is made with your express consent, obtained through the prize claim waiver. See Section 9(b) of the Contest Rules for complete details.

6. Intellectual Property

All content, features, and functionality of the Services — including but not limited to text, graphics, logos, icons, images, software, and the underlying code — are the property of Lodavo Inc. or its licensors and are protected by Canadian and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Services without our prior written consent.

7. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms.
  • Create more than one Account.
  • Use bots, scripts, or other automated means to interact with the Services, generate entries, or manipulate contest outcomes.
  • Attempt to gain unauthorized access to the Services, other users' accounts, or any related systems or networks.
  • Interfere with or disrupt the integrity, security, or performance of the Services.
  • Submit false, misleading, or fraudulent information.
  • Engage in any activity that constitutes fraud, including collusion, manipulation of balances, or exploitation of system errors.
  • Reverse engineer, decompile, or disassemble any part of the Services.
  • Use the Services in a manner that could damage, disable, or impair the Services or interfere with other users' use.

Violation of this section may result in immediate Account suspension or termination.

8. Mobile Application Terms

License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial use in connection with the Services.

App Store Terms

Your download and use of the App may also be subject to the terms and conditions of the applicable app store (Apple App Store or Google Play Store). In the event of a conflict between these Terms and the applicable app store terms, the app store terms shall prevail with respect to your use of the App to the extent of such conflict.

Apple Inc. and Google LLC are not sponsors of, nor are they involved in any way with, any contest, promotion, or prize draw operated through the App. Apple Inc. and Google LLC have no responsibility whatsoever for prizes, prize claims, or any aspect of contest operations.

Updates

We may release updates to the App from time to time. Some updates may be delivered over-the-air (OTA) for JavaScript-level changes, while others may require you to download a new version from your app store. Certain updates may be required to continue using the Services. You are responsible for keeping the App updated to the latest version.

Availability

We do not guarantee that the App will be available at all times or on all devices. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

9. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, LODAVO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, LODAVO DOES NOT WARRANT THAT:

  • The Services will be uninterrupted, timely, secure, or error-free.
  • The results obtained from the Services will be accurate or reliable.
  • Any errors in the Services will be corrected.
  • Bank balance data provided through Plaid is accurate, complete, or current.

LODAVO IS NOT A BANK, CREDIT UNION, TRUST COMPANY, FINANCIAL INSTITUTION, OR FINANCIAL ADVISOR. THE SERVICES DO NOT CONSTITUTE FINANCIAL, INVESTMENT, OR SAVINGS ADVICE. YOUR RELATIONSHIP WITH YOUR FINANCIAL INSTITUTION IS INDEPENDENT OF YOUR USE OF THE SERVICES.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LODAVO INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH:

  • Your use of or inability to use the Services.
  • Your participation in any Contest or draw.
  • Any inaccuracy in bank balance data provided through third-party services.
  • Any unauthorized access to or alteration of your account or data.
  • Any other matter relating to the Services.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LODAVO'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT OF PRIZES YOU HAVE RECEIVED FROM LODAVO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS ($100 CAD).

11. Indemnification

You agree to indemnify, defend, and hold harmless Lodavo Inc. and its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Services.
  • Your violation of these Terms.
  • Your violation of any applicable law or regulation.
  • Any dispute between you and a third party arising from your use of the Services.

12. Dispute Resolution

Governing Law

These Terms and any dispute arising out of or in connection with these Terms or the Services shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Jurisdiction

You agree that any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively before the courts of competent jurisdiction in the judicial district of Montreal, Quebec, and you consent to the jurisdiction of such courts.

Informal Resolution

Before initiating any formal legal proceeding, you agree to first contact us at contact@lodavo.ca and attempt to resolve the dispute informally for a period of at least thirty (30) days.

13. Electronic Communications (CASL)

By creating an Account, you consent to receive transactional electronic communications from us, including: account alerts, draw results, prize claim notifications, and other service-related messages. These are commercial electronic messages (CEMs) that are exempt from express consent requirements under CASL because they are necessary to provide the Services.

Marketing communications (promotional offers, newsletters, and similar messages) require your express consent and will not be sent without it. You may withdraw your consent to marketing communications at any time by:

  • Clicking the "Unsubscribe" link in any marketing email.
  • Contacting us at contact@lodavo.ca.

Withdrawal of consent for marketing communications does not affect transactional messages necessary to operate your Account.

14. Termination

By You

You may terminate your Account at any time as described in Section 2 (Account Deletion).

By Lodavo

We may suspend or terminate your Account as described in Section 2 (Account Suspension and Termination).

Effect of Termination

Upon termination:

  • Your access to the Services will cease immediately.
  • Any pending prize claims for draws that have already occurred will be honored, provided you complete the claim process within the required timeframe.
  • Tickets and number selections for future draws will be forfeited.
  • Your personal information will be handled in accordance with the retention schedule in our Privacy Policy.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

16. Modifications

We may modify these Terms from time to time. If we make material changes, we will notify you by email or through an in-app notification at least 30 days before the changes take effect. The "Last Updated" date at the top of these Terms will be revised accordingly.

Your continued use of the Services after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Services and delete your Account.

17. Language

These Terms are available in English and French. In the event of a discrepancy between the two versions, the version in the language you selected at registration shall prevail.
